Hearsay vs He Says/He Says/He Says in Natalie Wood Death Case

Put most simply by "law dictionary" online:

Hearsay rule
A rule of evidence that generally prohibits a person from providing testimony based upon what that person has been told or learned secondhand. Instead, the rules of evidence favor testimony based upon a person's own observations.

BUT, there are MANY variations of the Hearsay rule/law and it's open for interpretation by any court in any state in the USA. However, there is a difference between Hearsay and "He Says/He Says" which is what the Natalie case is about DIRECTLY in reference to the VERSIONS of those present the night Natalie died.

It's a He Says/He Says/He Says issue.

Walken says it was a pleasant weekend, there was some "debate" going on over Natalie's career, and that he WAS asleep, but then he has also said he was present when Natalie came to say good night. (two different accounts in two different interviews).

Wagner says he didn't see Natalie after she went to their stateroom, then 25 years later says he did see her brushing her hair, he says there was a "debate" too, and he admits (25 years later) that he did smash a wine bottle in anger. In one book he says that Natalie was there when he broke it, and in another book that she wasn't. He says - to this day - he called immediately for help, but records show that to be false. (MANY different versions of ALL accounts.)

Davern says NOTHING truthful about the weekend Natalie died was told to authorities. He explains that he was ORDERED to remain silent, sign a statement and be done with it. Within two years of Natalie's death, he started to tell the truth about the entire weekend and has never once lied or changed versions since he started talking... he has ADDED details as he gathered courage to tell complete details, but his account has never changed. HE HAS VOLUNTARILY TAKEN (AND PASSED) A CERTIFIED POLYGRAPH TEST TO SUBSTANTIATE HIS ACCOUNT AND IS WILLING TO TAKE A POLYGRAPH FOR AUTHORITIES ON THE WOOD CASE.

  2. I am going to answer this question as if I have never read GNGS, which I have.
    If I were on the jury, I would have doubts about all three of them as it is outlined here, for different reasons.
    Walken puts a question mark beside his own name because of the two different versions. Asleep or not? It's not a difficult question. And that puts doubt on everything he has said, what little there is. Walken would have a lot of explaining to do.
    Wagner has lied so much that even he gets confused. He saw Natalie, he didn't see her? He smashed the bottle, he didn't smash the bottle? He immediately called for help but the records say otherwise? It would take weeks for that creature to answer all my questions. Being the spouse automatically places him at the head of the line. And his version changes constantly. I have a feeling if we could get him on the witness stand, he would hang himself easily. None of his versions make any sense if you look at them in a continual timeline.
    As for Dennis, I would wonder why did he lie in the first place? Why not go to the police later and tell them what he knows instead of telling a friend? Why nearly 30 years later is he telling the full truth? Put simply, why wait so long? On the other hand, everything Dennis says lines up, point for point, minute by minute. He says the same thing each time. I also must add, and this impresses me greatly, Dennis never pretends to have seen or heard something that he did not. He is only saying what he personally saw and heard, having been present that entire weekend. All of it points to Wagner.
    Dennis had nothing to gain and probably a lot to lose by coming forward. Of course, I would and do believe Dennis.

    When did Walken say he was awake? Just a small point of contention. I haven't read anything Walken said except in one interview he said something to the effect of "People drown. Its sad they slip and fall." It was in relative terms and he didn't talk about his part.

  5. Rebecca, he gave interviews over the years in which he was asked about the night Natalie died. One was in Face magazine another in Playboy. In these interviews he tells completely different versions of where he was when he found out that Natalie was no longer on the boat. These interviews were available on-line years ago. You might try Googling Walken's name and the name of the magazine but this was quite a while ago.

  6. Dennis did not wait 30 years. He began to tell the truth only a few years after Natalie died but obviously the authorities where not interested in the truth.

  7. I too am confused about Walken's statements. It's been said that he gave interviews and it's been said he has remained silent. This is going to sound weird but I cant recall if I read it or dreamt it but didn't Walken once act very flippant and onnoxious about that weekend in some interview? Pardon my crappy memory.

  8. To be specific, he was asked about Natalie's death in interviews in years gone by. He did not give interviews specifically about Natalie's death.
    Rebecca made reference to the interivew in which Walken was a jerk.

  12. Only the first half of Walken's interview with Ployboy is available on the website. There is a reference to Natalie falling and drowning while he sat with Wagner in an onboard room. Those were his words. The part of the interview you don't see is where he went into greater detail. This was in 1987. The Face mag interview was a few years before.

  16. It is my firm belief that people who need the adoration, love and respect of millions of people have a loose screw somewhere. I mean, it's just not typical and normal behavior. Most people would be thrilled to have just a handful of folks who loved them or even the affection of a good dog would be enough, but to need the love of millions? There's something wrong there. Almost invariably celebrities are narcissistic, egotists with inflated opinions of themselves. Charlie Sheen is a very sad, recent example of this and what do he and Wagner have in common? ALOT. Think about it.

    There's no question that Wagner was abusive to Natalie, on at least one occasion that we know about and I'm betting there were other episodes as well. A man doesn't just decide to kill his wife on the first attempt at smacking her around...I could be wrong about that but I don't think I am. Charlie Sheen is a well documented spouse abuser and we can all clearly see by his crazy rants that he has most definitely got some serious mental /emotional/psychological problems. I don't know if being a celebrity makes a person a sociopath or they have to be one already to even want to live that kind of life so dependent on adoration from the masses. In any case, celebrities aren't like the rest of us. They will do or say anything they have to to remain in the limelight.
    Charlie and RJ have much in common.

    Then in the Playboy interview in 1997he says that he was with Wagner in the Salon.

    In both articles he is really blase' about the whole thing or at least comes across that way. I think he was brainwashed over the years by the media accounts and has forgotten the truth. I really don't think he gives a crap about this and I find it odd. If I was somewhere when someone drowned, I would be haunted by that. But Walken is a weirdo in general.

    Just as I said earlier. He gives a different version of where he was when Natalie went missing. He's is not credible. The most credible person is Dennis! He's the one that Rasure labeled "a liar" but he does not dare say a negative word about the celebrities involved and it's been confirmed that both of these celebs that he so courteously ordered a helicopter for lied to his face!

  19. BTB, I agree wholeheartedly with you! Wagner and Sheen are very much alike. They think they are ultra special. They both are known to abuse women.

    In Walken's statement of 'I was asleep when it all happened' I have to ask: what does 'it' refer to? 'It' being her drowning? 'It' being the argument he may have heard? To call her death 'it' is so insensitive.

    I would never want to be a celebrity.

    this is sort of unrelated but have you ever wondered what Wagner and Walken talked about the night that Natalie went ashore with Dennis? I wonder about that. They were alone on the boat. Did they drink and talk about Natalie. If I had been Walken that would have been a really awkward night but there is no mention of that. I wonder if Wagner had planted seeds in Walken's head- depicting Natalie as being unstable and one to run off when they bickered. I say this just because maybe Walken wouldn't have thought much of Natalie trying to escape by boat- since she had left the night before. But frankly, I don't think he gave a crap about any of it. He obviously didn't give a crap about his wife either, since she wasn't with him for the Thanksgiving weekend.

    Walken was in bed before Natalie left the yacht. Dennis went to Walken in his room to ask him to help settle an argument RJ and Natalie were having Friday night when RJ wanted to move the boat to the Isthmus, the quiet part of the Island (where they went on Saturday and had dinner--the restaurant is really the only tourist spot on that part of the Island...it's about 12 miles away from Avalon where all the stores are.)

    Christopher told Dennis he didn't want to get involved and told Dennis he should stay out of the marital argument, too. But Dennis went back to RJ and Natalie to help calm them down. The argument was about RJ wanting to move the yacht so late at night in terrible, rainy weather. RJ insisted he was going to do it and went to the wheelhouse to gun the engines, and was pulling anchor (you anchor in Avalon and moor at the Isthmus...there'a a difference...the water is deeper at the Isthmus).

    Natalie started packing a bag...and that's when she left to go to Avalon with Dennis. I have no clue if Walken got up and spent time with Wagner after Natalie left, but I doubt highly doubt it.

  24. On the night Natalie died, I think it's possible Walken heard some of the fighing that went on.

    He went to his room shortly after the bottle incident. The fighting between Natalie and Wagner also started soon after that incident. It's possible that Walken heard them fighting before he fell asleep.

  26. On the surface, if I knew nothing more than the statements the three men made, I wouldn't believe any of them. However, after passing polygraphs, I would have to give far more weight to Dennis' statements.

    I would like to see Wagner and Walken be made to take polygraphs. Like Kevinr, I believe Walken had to have heard something regarding the argument between RJ and Natalie.

    I'm not defending RJ, as I'm not a fan of his, and I do believe he had a hand in Natalie's drowning, but I don't think he's as bad as Charlie Sheen. Sheen is a habitual drug user and has been arrested for abusing women many, many times. His life is totally out of control. RJ had no history of abuse before the night Natalie drowned, and according to Dennis, RJ hated to take any medication of any kind. He didn't like drugs, and Dennis has said RJ only went along with the Quaaludes so as not to appear "older" in front of Walken (or something very similar). Sheen, by his own account, is very much into recreation drugs. Wagner, according to Dennis, was not.

    Only the 100% truth can best serve Natalie and justice. Yes, it seems there was no way Wagner was not involved, but he's not like Charlie Sheen.

  28. I wasn't saying that Sheen was a murderer. And I didn't say Wagner was a drug addled moron, I was illustrating how far celebrities go to ensure they remain in the limelight. For Wagner, he felt the need to kill someone to protect his image. For Sheen he went nutz in public...the point is these people will do ANYTHING to stay in the publics good graces. Its a celebrity trait in my opinion.

  29. Neither. I would keep my last drop of water for myself. Most definitely. I am selfish when it comes to survival. Even if I had enough, I would not share water with either Sheen or Wagner. Certainly not Sheen. He's an abomination. But he's not the focus here.

    Sheen and Wagner are not really alike. Until that night, according to Dennis, he thought RJ and Natalie had a very good marriage, with only minor tiffs. That can't be said of Sheen. And while Sheen's life is spinning totally out of control, Wagner kept (and still keeps) a tight grip on his. He exercises a lot of control.

    I think RJ probably hit or shoved Natalie hard enough that she staggered and fell into the water. Then I think he panicked and refused to help her. Even if that's not how it happened, that's murder, of course. I think he regretted it, but that doesn't negate any of what happened. Not at all.

    I think people are reluctant to see Wagner as involved because spouses, even when angry, usually don't kill, and RJ and Natalie had no history of violent fighting. RJ was not known as an abuser like Sheen. I believe Dennis, but I'm surprised RJ acted that way. I would not be at all surprised if Sheen did. I fully expect it out of him.

    Again, I think only the 100% truth can serve Natalie and justice, especially since the 100% truth has been covered up for so long. I hope the case is reopened and the other two men, Walken and Wagner, are made to tell their stories in detail and take polygraphs.

    Walken is the one I hope has read the book. Because he fell asleep that night, I think he has convinced himself that Wagner didn't kill Natalie. But if he has read the book--and knows what went down--he can't pretend anymore.


    It makes sense Walken hasn't come forward. Look at the way he reacted to Dennis asking him for help with Natalie and Wagner, and the way he reacted to Wagner's outburst.

    It's as if he doesn't know how to deal with human drama (or he doesn't want to get his hands dirty)? Maybe he saves it for the screen?

  32. The women Sheen has abused lived to tell about it. Natalie was not given the chance to tell what her husband did to her. Wagner was cold and calculating. He let her fend for herself in the cold, dark water while he sat and drank and concocted what would be said and what would NOT be said about that night.
    His actions were not that of panic. He was in total control from the time he put or pushed her in the water, releasing the dinghy so that he could tell Dennis that the dinghy was gone giving the illusion that Natalie took the dinghy. Panic? Hardly.
    He keeps a tight grip as he lives a lie with that charming smile. He's despicable, certainly, no better than Charlie Sheen.

  35. Kevinr, I agree that Walken has been covering for Wagner all these years. I'm sure he still doesn't want to "get involved," but hopefully, he'll be made to take a polygraph and more will come out.

    I don't think Wagner initially did mean to kill Natalie, only hit her, but I think after she went into the water, he did make the decision to let her drown, which is murder. He didn't jump in to save her, after all.

    He shot Kelly Preston. He held a knife to Brooke's throat, and terrified a prositutute in NY a few months ago and she locked herself in a bathroom to call for help.

    Here's the difference between Sheen and Wagner:
    Wagner: Quiet lowkey sociopath, career-induced
    Sheen: Loud & proud sociopath, drug-induced

    Does it make a difference how they became sociopaths? No, they are very much alike. Both harm women.

    Talking about it here does not sully Natalie in any way possible. Hollywood has a long history of letting sociopaths get away with murder. It may be unfair for the memory of those slain, but it does not sully the victims. It's the very subject this blog is about, no?

It's like for every scandal we find out about there are probably 10 others that we don't. Sadly, the ones we do find out about tend to have a happy ending for the offending party. OJ, USED to be one example of that ...but I must admit I LOVE that he's behind bars even if it's not for killing his wife. That's justice enough me me.

  47. OJ going to jail was the best what-goes-around comes-around event of this century. That he got off from the criminal trial of last century was sickening.

    I agree there's a bigger issue at hand related to Natalie's death. This pampering of celebrities who do terrible things to others, and go scott free has happened far too many times. What would happen to you if you were caught with a brief case full of cocaine as Charlie was? What would happen to you if they pulled your wife's (or husband's) body from the ocean and it was covered with dozens of fresh bruises? Think the detective would take your word on it that you called for help right away? Rasure didn't even check the records on that! I didn't know until GNGS that there was such a terribly long wait to help rescue Natalie! It sickens me because I really cared deeply for Natalie Wood and still do. I think it's the actors more so than the actresses who let stardom go to their heads. I really don't think it's equal. No offense, guys, but I think it's that way.

    The similarity between them is they are both smug. They are both self-involved Narcissists. Wagner is a functional alcoholic and Sheen was probably one too. I don't think Sheen's antics were while he filmed the show and interestingly enough both Wagner and Sheen were on Two and a Half Men.

    We will never know what went on behind closed doors. Just because there are no reports of abuse toward Natalie-that doesn't mean he wasn't abusive to her. People keep this stuff to themselves because they don't want to get divorced and they know people will say- you have to leave him.

  49. Wagner got away with murder and for that, I blame Duanne Rasure! He failed miserably at his job. He was totally star struck and who knows what else! With OJ, the police actually tried to do their job. That was not the case with Wagner. He was treated with kid gloves. You or I would not have had a helicopter summoned for us. We would have been INTERROGATED! We would have been asked why we waited so long to report our spouse missing. We would have been checked head to toe for marks. We would have been asked about every moment on that boat. None of this happened to Wagner. That's on Rasure!

  50. Wagner's narcissism was vividly displayed in his memoir. He seemed totally consumed with himself. He praised Jill for being 100% for him. That speaks volumes about him, that he NEEDS the woman in his life to be 100% for him, that she must sacrifice her own happiness to make him happy. He has spoken many times about Natalie's demons. Her "demons" being things that she might have wanted to do to fulfill her own happiness rather living and breathing to make him happy. This was present the night she died. How dare she want to do something that made her happy!

    I agree! Rasure's investigation should have been investigated. It should be investigated!

    I can't imagine a detective allowing a helicopter to take home the husband of the wife who was just found floating in the ocean. He did so without interrogating the husband or the other men on board the Splendour. I believe that is why Rasure reacted the way he did when Marti spoke to him about the information printed in GNGS. He does not want another detective looking into this case. Rasure and his investigation will not hold up to scrutiny and he knows that. He knows he did a lousy job.

  52. Yes, Kevin, the last thing Rasure wants is for there to be a closer look into the way this case was investigated. This is why everyone connected to the investigation is quiet. They know that Rasure failed to follow any type of procedure in this case. As Rasure said, any unexplained death is considered a homicide. This case was a sample the procedure in a homicide investigation? I think not! It was an example of celebrity privilege coupled with a star struck detective or a detective on the take. That can't be ruled out under the circumstances.

    Does anyone know what story Christopher Walken originally told to the police? There was speculation that he might have been the first one to mention the bottle smashing incident. Is that true?

    On a side note, please stop the fighting and name calling on this blog! It's not productive and surely there are better ways to get your point across without being condescending.

  63. Walken said little. He mentioned there was an argument, You would think that would've concerned Rasure but it did not. Walken did not mention the bottle smashing. No one told the police anything about the broken wine bottle and Rause ASSUMED it was "rolling seas" -- Rasure asked no questions about the broken bottle, and this was glass shattered all over the main salon.

    SOmething else that was in the police report that is interesting: there was other evidence of an argument: the party that sent a bottle of wine to the Wagner party at Doug's restaurant and who supposedly called the SPlendour to invite RJ and Natalie over for a frink (but Dennis does NOT recall this phone call) said he heard arguing in the background. There were many clues of an argument Rasure ignored.

So, in other words- just disregard posts that contribute nothing to the dialogue. That goes for the Wagner fans and the rabid Wood fans. People like hearing thoughtful remarks not crass ones.

  71. Good advice Rebecca. We are all adults and should conduct ourselves as such. I ignore the ignorant posts and Marti's quick to delete them. It doesn't have to become a distaster. What happened in Japan is a disaster. Trolls are everywhere, although Marti looks fed up in the other thread. I don't blame her, but, Marti, we're with you. We know how to sidestep the nuisance.

  72. Rebecca, this might sound blindsided but there really are no rabid Natalie fans here, except for the troll who claims to be a Natalie fan but is obviously a Wagner fan. We've dealt with the troublemaker for years. It's as if GNGS destroyed his ability to live a normal life. It's basically one real doozie on the lose, and the difference between Wagner and Wood fans is that I've never seen a Natalie fan get out of hand, and I've been to all the discussion sites and forums. Natalie fans stay sane and the Wagner fans do nothing but lie, exaggerate, and condemn the facts. I tell you this with all due respect because you make a good point of suggesting we all watch our tone but GNGS is the monster no Wagner fan ever wanted to encounter.
    It gets old, fighting them, but we must because they will do everything in their power, down and dirty, to destroy the facts involved. People do like hearing thoughtful remarks, and I hope you believe this is one of them.

Yes, many of us know how far it has gone and what sickens me most is that new people who are interested in the facts about Natalie's death, people who love Natalie, and also care about her life, must endure this kind of nonsense. I love the way everyone gets along here until that wrench is always thrown into the works, and I know who is doing it. There is ONE PERSON responsible. Period. ONE! It throws us all off and sadly makes it appear that there is more than ONE. There's NOT. It's ONE. We all remain civil with one another until he feels the need to make a good thread go bad.

I will continue deleting and saving the comments to keep in a file with all the fradulant emails this person has sent me, and it may take a little time and effort, but I'm confident we will all be rid of this nusisance soon.

  84. In a recent reminisces from actress Ann Jillian who worked with Natalie in "Gypsy":

    "Natalie Wood: Soft and professional. When I say "soft," by no stretch of the imagination do I mean "weak." Her carriage was that of a princess. Her beauty, haunting. Talent? Pure. Mervyn LeRoy once said of her ability to convey emotion, "She's the only actress I know that can make a single tear feel a hundred different ways." Her generosity, particularly to me, both onstage and off, touched me forever.
    She knew the tender concerns my heart held, having been a child actress herself. It was easy to say the lines,"you never worry about yourself, only for me." She did. She made me feel comfortable in what was not yet my arena; always gently leading and helping.
    On my final day of shooting, she delighted me with a surprise visit to my school room. I was dismissed for a moment to receive a most beautiful gift from her.
